Усиление крепостнических тенденций по отношению к при­борным служилым людям на Белгородской черте

Усиление эксплуатации мелких служилых людей в Белго­родском разрядном полку и на Белгородской черте во вто­рой половине XVII в. отразилось и в русском законодатель­стве. Исходя из военных потребностей страны, правительство во время строительства Белгородской черты в какой-то мере охраняло землевладение служилых людей юга от вторжения крупных феодалов. 1 апреля 1637 г., вскоре после утвержде­ния Боярской думой плана Ф. Сухотина и Е. Юрьева, преду­сматривавшего крупное военное строительство на юге, был принят указ, запрещавший приобретать в южных городах поместья и вотчины служилым людям думных и московских чинов («бояром, и окольничьим, и думным людем, и столь­ником, и стряпчим, и дворянам московским, и жильцом, и дьяком»). Указ сохранял силу до 70-х годов. Не следует думать, что правительство стояло на страже интересов мелких служилых людей юга; правильнее сказать, что оно просто перекладывало на плечи мелких служилых людей черновую работу по строительству черты, отражению татарских набе­гов и освоению края. Когда же дело было в основном сделано, когда мелкие служилые люди своим трудом и ратными подвигами отстояли от татар и освоили для России черноземный край, охрана землевладения служилых людей юга пре­кратилась. В 70-х годах крупное феодальное землевладение распространяется в уездах к северу от Белгородской черты, а в самом конце XVII в.— проникает и на черту.
Усиление крепостнических тенденций по отношению к при­борным служилым людям на Белгородской черте заметно и в законодательстве по крестьянскому вопросу. Уложение 1649 г., как известно, отменило урочные годы сыска беглых крепостных крестьян и холопов. Крестьяне, записанные за владельцами в писцовых книгах, признавались крепостными навечно, со всем своим потомством. Строительство Белго­родской черты не было еще тогда завершено, и военная не­обходимость вынудила правительство дважды, указами 1653-и 1656 гг., устанавливать все же, вопреки общей норме Уло­жения, новый исходный срок сыска беглых крестьян для Бел­городской черты. Указ 5 марта 1653 г. предусматривал не отдавать владельцам крестьян и холопов, бежавших на чер­ту до принятия Уложения (до 1649 г.), «чтоб черты не опу­стошить». Указ 20 марта 1656 г. отодвигал начальный срок сыска беглых до 1653 г. для украинных городов и черты.
В первой половине XVII в., в ходе строительства Белгород­ской черты, правительство делало иногда небольшие шаги в сторону ущемления интересов дворянства: переводило офи­циально крепостных крестьян в положение приборных служи­лых людей, изредка смотрело сквозь пальцы на запись беглых крестьян в стрелецкую или казачью службу. Эти дей­ствия проводились в интересах обороны южной окраины и вызывали недовольство дворян. После 1653 г., когда в основ­ном завершились строительные работы и комплектование гарнизонов на Белгородской черте, правительственных акций такого типа мы уже не видим. Наоборот, на Белгородской черте проводятся массовые сыски беглых крестьян (Воронеж­ский уезд—1660, 1666 гг.; Усманский уезд—1660 г.; Коз­ловский— 1661, 1662, 1664, 1665 гг.). Крестьяне, бежавшие на черту и даже записавшиеся в службу, возвращаются вла­дельцам. Сами укрепления Белгородской черты начинают ис­пользоваться не только для отражения внешнего врага, но и для задержания беглых, направлявшихся за черту.
При всем разнообразии конкретных поводов к отдельным выступлениям мелких служилых людей, низов посада и кре­стьян на Белгородской черте, народные движения вспыхи­вали здесь закономерно, в ответ на усиливавшуюся феодаль­ную эксплуатацию.
